Professor Montgomery Makes Case for Consistent Approach to Fair Use Doctrine Before the ABA House of Delegates

In January, Professor Susan Montgomery spoke before the American Bar Association (ABA) House of Delegates in favor of a resolution encouraging courts to take a consistent approach to the “fair use” doctrine, a defense to copyright infringement that permits use of copyrighted works for free without obtaining a license or permission in appropriate circumstances. Montgomery, a member of the ABA’s section of Intellectual Property Law, contended that the resolution addresses an issue that is faced often by both copyright owners and users.
