Will the Supreme Court Wade Into the White House Fight Against Mail Voting?

Northeastern Law faculty weigh in on whether the Supreme Court will take up the fight over mail-in voting, as the Trump administration asks the justices to revive an executive order requiring states to submit lists of mail voters ahead of the November election.

Professor Martha Davis noted that judges across the ideological spectrum on the First Circuit have agreed it’s too late in the election cycle to make such a change. Professor Jeremy Paul, former dean of Northeastern Law, said he expects the Court to either decline to intervene or leave the existing injunction in place without ruling on the merits. And Dan Urman, director of Northeastern’s law and public policy minor, said the case gives the justices a chance to demonstrate independence from the administration, noting that most of the current bench appears disinclined to intervene on the shadow docket in Trump's favor.
